This website is operated by River Daughter LLC. Throughout the site, the terms “we”, “us”, “our”, “my”, refer to River Daughter LLC. River Daughter LLC offers this website including all information and services to you, the user, conditional on your acceptance of all terms, conditions, policies, and notices. River Daughter provides certain products and services through a). this website, b). various social media accounts including without limitation Instagram, Facebook, TikTok, and Pinterest, and c). through various other messaging, telephone, and mobile technologies.

By visiting our website and/or purchases something from us, you engage in our “Service” and agree to be bound by the following terms and conditions. These apply to all users of the site including those who are just browsers, vendors, customers, merchants, and contributors or consumers of content. Please read these Terms of Service carefully before accessing or using our website. By access and use, you agree to be bound by these Terms and Conditions, our Privacy Policy, and the policies contained in our FAQ. We reserve the right to update, change, or replace any part of these Terms of Service by posting updates and/or changes to our website. This site is hosted on Squarespace and Stripe, which provides us with an online e-commerce platform allowing us to sell our products and services to you.

AUTHORIZED USERS

You affirm that you are at least the age of majority in your state or area of residence, or that you are the age of majority and have given us your consent to allow any of your minor dependents to use this site. You may not use River Daughter services to purchase any product for resale by yourself or another person. You may not use our products or services for any illegal or unauthorized purpose that may you violate any laws within your jurisdiction. You may not transmit any virus or code of a destructive nature.

GENERAL CONDITIONS

We reserve the right to refuse service to anyone for any reason at any time. This includes any breach to these Terms. You understand that your content (excluding credit card information) may be transferred unencrypted over various networks. Credit card information is always encrypted. Please review our Privacy Policy for how Squarespace and partners make use of your information. You agree to not copy or duplicate any portion of this service or site materials without explicit written permission.

EVENT BOOKING PROCESS AND PROCEDURES

Our event booking process for custom work is displayed on our Booking page. By filling our our Inquiry Form, you agree to be contacted by River Daughter through the email or contact information you provide. All booking inquiries are also subject to the contract and payment schedule provided upon retention of services.

PRICING

Prices for our products and services are subject to change without notice. We reserve the right to change, add, modify, or discontinue products and services without notice. Prices will be those in effect at the time of purchase in U.S. dollars and unless otherwise stated, exclude shipping, handling, taxes, fees, and duties. All pricing and products are subject to availability. River Daughter reserves the right to accept, cancel, reject, or modify any order to correct errors. You authorize River Daughter to receive and disburse funds in accordance with your payment instructions.

SITE IMAGES

Images are for display purposes and example only. Actual product may differ from the product displayed, in accordance with maintaining the highest level of client satisfaction and creative brief guidelines. All images are not to be reused without explicit permission of River Daughter or the Photographer associated.

CONTRACT CHANGES & CANCELLATIONS

For event services, Client understands that this is a custom order. Contract cancellation must be made in writing or by email. Contract cancellations made before final payment due will receive a refund of monies paid, less the non-refundable deposit. Cancellations made after the final payment date will receive no refund. If you decide to reschedule your event prior to the final payment date, we are happy to do so given that the date is available. After the final payment date, rescheduling will be considered a cancellation. 

SUBSTITUTIONS

Flowers are a piece of nature, subject to their own seasons, weather, production, and shipping cycles. Florist will order premium flowers from reliable growers and try to provide the freshest product possible that aligns with the client’s vision. Occasionally weather, shipping, or production issues may not allow for a specific flower to be used in your design. In this case, florist will substitute the flower keeping your vision and best wishes in mind. No specific varieties can be guaranteed, but florist will make every effort to ensure the final product is of high quality and meets the design prompt. 


WEATHER

Weather conditions may sometimes accelerate the perishability of floral products. Florist will use industry standard procedures to attempt to combat such weather conditions and preserve the fresh look of flowers for the event. However, florist is not liable for product damage due to weather or influence outside of the parties’ control. 

PHOTOGRAPHY & PERMITTED USES

Florist may take and use photographs of specific works of art created at locations specified in contract unless otherwise discussed. Florist may reproduce, publish, exhibit and use said images as samples of work to be shown on website and social media, in print or electronic form, and for both display and marketing. Any use will be with the highest standards of taste and judgement so to reflect positively on said event. 

LIABILITY  

Florist is not liable for:  

- Floral damage after setup due to weather or mishandling.  

- Venue restrictions preventing proper installation of rentals.  

Indemnification:

- Client releases River Daughter from liability arising from injury to person(s) or property sustained at the event. 

- Unless explicitly stated, florals are not edible. 

In the case of extreme illness or other reason that renders florist unable to perform the obligations in the contract, florist will either enlist another florist to cover the event, or refund all monies to the client, not in excess of the amount the client has already paid.
